WE WON FOR THE THIRD TIME AGAINST KATE MCIVER SKIN

On 29th November in the High court of appeal, we won against Kate McIver Skin on the Debarring application initiated by us as they breached the Injunction Order issued on 20th April 2023, KMS has been ordered to provide disclosures as follows:

 1) By service schedule setting out an a monthly basis to date the sales received & receivable from sales of the 1st Pelham reformation ((Secret Weapon Limited Edition) & 2nd Pelham reformation ((Secret Weapon Original)) using the nomenclature from the judgement of his honour Judge Hacon .................. attaching relevant documents."

Normally applications such as this would cost circa £4000 and be included with the the IPEC costs CAP.  Judge Hacon departed from the IPEC costs regime on account of the Defendants (KMS) EXTREMELY UNREASONABLE CONDUCT  and ordered they pay £8000 within 14 days.  Also his honourable Judge Hacon was very generous in giving them a 2nd chance to submit financial information with supporting documents within 28 days.

KMS can refused to engage but we have no hesitation to take them back to court for breaching any court order and due to this, we are incurring additional legal fees of thousands of pounds, as we never fully recover 100% spent on costs except in this debarring application.
Currently we are waiting for a court date to force KMS to settle the legal costs incurred by us in the Security costs application that we won in end of September. Basically the loser pay around 60-65% of legal costs incurred by the winner.
